Terms of Use

Golf Cars/Bikes/Scooters may only be operated on transportation trails and certain public streets within
The Villages® and Middleton communities. For your own safety, and the safety of others, Customers must
follow all applicable traffic laws and regulations.

The word “Customers” as used in this Agreement means the individual(s) named below, and
if more than one, then all of them, jointly and severally.

Customers must have a working knowledge of vehicle and bicycle traffic laws. This includes the use of
hand signals and turn signals when stopping or changing directions. Customers are solely responsible
for complying with all applicable traffic and bicycle laws, including but not limited to Florida
Statutes Section 316.212, Florida Statutes Section 316.2065, and applicable local laws governing use of
Golf Cars/Bikes/Scooters on public and private roadways.

Failure to Return Hired or Leased Personal Property

3. Whoever, after hiring or leasing personal property or equipment under an agreement
to return the personal property to the person letting the personal property or equipment or his or her
agent at the termination of the period for which it was let, shall, without the consent of the person
or persons, knowingly abandon or refuse to return the personal property or equipment as agreed, commits
a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083, by law, unless
the value of the personal property or equipment is $300 or more; in that case the person commits a
felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084 by law.

Operating Restrictions
  • Golf Cars/Bikes/Scooters may not operate on or be transported across US Highway 441/27, 301, CR 466,
    466A, Highway 42, SR 44, and various other roads except by way of golf car bridges or the golf car
    tunnel system.
  • Use the transportation trails at all times when possible.
  • If mechanical problems arise (especially engine, tire, steering, or light failures), stop operation
    immediately and notify The Villages Outdoor.
  • Golf Trail (Green) Fees are not included.
  • Only the designated Customers may operate the Golf Car/Bike/Scooter.
  • No smoking is permitted in the Golf Car/Bike/Scooter.
  • Tampering with the speed of the Golf Car/Bike/Scooter is prohibited. If detected, the Customer will
    be responsible for all repair costs.
  • Only two persons may sit on any bench seat in a Golf Car.
  • Only one person may operate or ride a Scooter/Bike.
  • Helmets are required at all times when operating Scooters/Bikes regardless of age.
Rental Fees and Return

Rental fees are non-refundable. Return of the Golf Car/Bike/Scooter and keys must be completed during
normal business hours at the same location where the rental originated.

Risk of Loss and Damage

Customers acknowledge that they have inspected the Golf Car/Bike/Scooter and determined it to be in
good condition and repair. Customers assume all risk of loss and damage to the Golf Car/Bike/Scooter
and any personal property stored within. The Villages Outdoor may charge the Customer’s credit card on
file for repair costs related to damage incurred during the rental period.

Hold Harmless and Indemnification

Customers agree to indemnify and hold harmless The Villages Land Operating Company, its affiliates,
owners, officers, directors, employees, and agents from any and all claims, losses, causes of action,
liabilities, expenses, attorney fees, or legal expenses, including those arising from personal injury
or death related to the use or operation of the rented Golf Car/Bike/Scooter.

Customer Representations and Assumption of Risk

Customer represents that they:

  • Are over the age of 16
  • Are competent to operate the Golf Car/Bike/Scooter
  • Hold a valid, unexpired driver’s license
  • Are knowledgeable of applicable traffic laws
  • Are familiar with operation of the vehicle
  • Have inspected the Golf Car/Bike/Scooter
  • Accept the Golf Car/Bike/Scooter in its “as-is” condition
  • Understand helmet requirements under applicable law
  • Assume all risks associated with use
General

The parties agree that the prevailing party in any action to enforce this Agreement shall be entitled
to recover reasonable attorney fees, consultant fees, and related expenses incurred at trial,
appellate levels, and in any bankruptcy, collection, administrative, or dispute resolution proceeding.
